no one can tell you for sure what to use the money on. remember that if the trustee feels that you sold the vehicle and spent the money to hide then it might be considered fraud.Im not an attorney or a trustee. You cant trust me either though!

We've thought about refinancing the car to get the equity out before we do anything,........ like possibly filing BK. The car will be financed to the max so no equity there. That means that car would not enter into the picture as an asset. Then we'll have money to pay attny's fees, auto insurance and/or taxes. We've even thought we could use some of that money to "redeem" the tad extra in equity we'll may have in vehicles and be able to keep hubby's truck, or both kid's cars.
Other people need to make repairs to their home, buy clothes, new tires for the car, much needed car repairs. There's a whole bunch of necessities you can find to spend the money on.Filed Ch 7 - 09/06

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

Alrighty
yeah he should have given me a list.. he mostly just suggested the school.. which since he probably assumed it would take most of the money (which it will) that he didn't need to offer any others. It's just more of a pain in the ass trying to get in touch with them than asking
. Hmm I could use some new clothes I'm sure. Car still hasn't sold on ebay..and it's going real cheap.. guess I'll have to sell it locally!

"While you may able to keep some assets, you also keep some debt. Certain debts, no matter what state you live in, cannot be discharged. For instance, any debt owed to a single creditor totaling more than $500 for luxury items bought within 90 days of filing are non-dischargeable; cash advances of $750 within 70 days are also non-dischargeable."
but if you have already filed then you can buy what you want. however, in any case a gun could be considered a needed item.Im not an attorney or a trustee. You cant trust me either though!

Technically, any firearm has to be listed as an asset. They are also one item often seized by the Trustee, since they can easily be converted to cash. Some trustees even ask if you own a gun. Be careful there.
I looked for things which I could purchase and possibly redeem for cash later. Wound up paying estimated taxes and stocking up on essentials from food to cleaning products to toiletries.
You could do this and just show the checks made out to the gricery or clothing stores. Doesn't really take too much to go through $500 - $700.
When you're through, the freezerand pantry are full, you have 6 months worth of toiletries and cleaning supplies. Helps with the recovery process. Wish that I had done more of it, but w/ the attorney's fees, I wound not having hardly any cash. Art

if you rent, you could prepay your rent...take a vacation and go shopping during it! Cozumel is beautiful in April...(what's left of it???)...You can also get an AMEX card and load it up with I think up to $10K...and spend it as you need it, like a prepaid charge card...Filed Oct 2005discharged February 2007,Shapeless in the fire's glow, tell me if you think you know,

I'm not sure the idea of prepaying rent would work, in all honesty. That might be considered an asset, as having a credit from overpayment means that you are owed money.
Auto insurance, on the other hand, is often billed in 6 or 12 months increments, with the option of making montly payments.
Ps-I'm guessing the vacation was a joke!!Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

Pre paying rent could be a preferential transfer if within the 90 days. If your normal rent is over the $600 paid then that's fine, but if you were to pay late rent payments to get caught up inside the 90 days then that is a preferential transfer and the trustee would get the money from your landlord. If you paid ahead I imagine it would be looked at the same way.
