    Bk, Judgment, And Irs Questions

So I've been getting since last monday tons of letters from attorneys soliciting my business to file BK after i got a "abstract of judgment". I did received something to that effect at my job about a month or two ago. But nothing on an "abstract of judgment". It was some other court form stating they were filing for judgment. Anyhow, so now, i have made up my mind of filing for bk, but i got no $$$. I just filed my taxes (i was later advised i shouldn't have done this) and i'm getting a refund of approx $4,000. I'm hoping to use the refund $$ to pay for bk - getting an attorney. I'm a single mom, making about 36,000 a year. I own nothing, the only thing under my name is a car i purchased from a friend, and i'm using the rest of the tax refund to pay for that car. I'm approx. $15,000 in debt after getting a separation.

So what happens? How much time do I have to to file a bk before they try go garnish my wages? I'm trying to beat the clock, i just don't know how much time i have. Also, what about my taxes? Will they hold that too. I e-filed them, so i should be getting my refund within a week.

well first off seek multiple appts with attorneys. they are free. you will learn very fast.

secondly, what happened to you was this:

    - first they sued you in civil court.

    - then they asked for a default judgement cuz you didnt show up.

    - then they probably recently placed a lien on your for that judgement. that will cost you an extra 3-500 dollars to take off if an attorney does it. maybe they didnt. attorney can tell you.

if you only owe 15K maybe thte attorney can look over whats going on and help you see it its worth filing bk.

most likely if you get that tax spent on needed things before you file then the trustee prob wont do anything.

lastly, there is no telling how long it will take for them to garnsih your wages. its up to them. you can stop it by filing bk but remeber to plan when you file so that you adhere to the rules of the new laws.

tell your attorney how soon your lasts charges were and cash advances.
Im not an attorney or a trustee. You cant trust me either though!
