This question may have been asked before.
But how difficult is it to be granted a chapter 7 in Ohio?
Our house is unlivable due to a lead/soil contamination issue. We have no one to sue and nothing we can do about it. I refuse to pay for the home. We have only a few thousand in other bills.
I make decent money and want to file chapter 7 to get a fresh start on life. What I don't want is to spend the money for my lawyer and then have my chapter 7 rejected or it create other legal issues.
Any thoughts or questions?
tia

If you house as bad as you think it is then the lien holder would probalby not want to forclose on it. If they did they would be in the chain of title and have to clean it up.
Have a qualified person really check it out and give you an "opinion" as to need and cost. In the business what this report is called is a Phase I and II report. Most real commerical estate a clean Phase I report is required. Phase II estimates the cost of clean up.
You then send that report to the lender and if it is bad enough you may have a free house.
An attorney can also advise you on legal real estate issues.
Thanks,

Yes, I think emoney is correct on this TheJaspMan~
I have a real estate license, and I know things vary from state to state....but I am sure what emoney said is correct~ I would follow his advice as an option!!

Actually emoney opened the old thread, CAB. You just responded to emoney's post....no worries.
The rule asking all our members to not open threads with the last post made more than a few months ago exists because (1) often the people who originally posted for advice aren't actively looking for answers to those questions any more (they may not even be active members any longer), and (2) with the changes in the new bk law implemented last year, the information in an old post may not be accurate any longer. Best to just start a new thread.
