I know this is a dumb question, but at the time I filed (8 months ago) I didn't expect to be getting a new job (with a hefty income increase) so soon. Since I'm relocating with this job (to a much pricier part of the country), my cost of living is actually going to be double what it was before, which means my monthly expenses will also increase. I plan on reporting my income increase to the trustee, but do you think he'll request that I refile all that paperwork that lists my expenses and such to determine my new disposable income? What then, another 341? Also, since I'm now out of state will I be transferred to a local trustee? Right now I'm paying the minimum, monthly. I expect an increase and am fine with that, but I don't want him to take so much that I can't live comfortably.

A couple of questions first....do you own a home that needs to be sold before you can move? Did you use a lawyer to file your Ch 13 case?
With your substantial increase in income combined with a substantial increase in expenses, you are an excellent candidate for requesting a plan amendment. Since you filed under the old law, you will still use the old law for figuring out expenses, income, etc. Under the circumstances, using a lawyer to file your request to amend your plan is the safest route.

Yes, I did use a lawyer and no I don't own a home, nor do I plan on buying. I'm over 1200 miles from where I was when I filed. Should I find a different lawyer in my area? Is there a way to get around it w/o having to get a lawyer for the plan amendment? I'm working on teacher's pay, so although I'm making much more than I was, I'm still not making enough to blow my wad on an attorney.

Since a new bk lawyer in your new location won't be familiar with your current state's bk codes, doesn't know your current trustee, and won't be famliar with the unwritten bk rules in your local bk district, although it might be more convenient for you to have a lawyer close by, it seems to me changing lawyers at this point could hurt your case in the long run. Better to stay with your current lawyer and stay in touch with him/her by email and phone as needed. I recently called my attorney as I will be changing jobs within the next couple of weeks. He instructed me to call after the change to update the mailing address of my new employer. This new job will be within the same city.
My pay will not be changing much; thus, I am not expecting a drastic change to the automatic deductions from my check.09/16/2004 - Filed Ch 13

I found out this morning that my first paycheck doesn't come until Sept. 16, over a month after I start my new job. With all that I've saved this summer being blown on moving expenses there is NO way I'm going to be able to pay rent at the beginning of september. Is it legal for me to go to one of those payday advance places to borrow the money even though I've filed bk? Or do they check your credit too? (I know this sounds naive, but I've never used one).

You cannot incur new debt without permission on the trustee during a Ch 13.
Congrats on the new job and pay increase; however, sorry about what a pain it is to go through this all again.

What kind of person moves across the country, and then has no money to live upon getting there. This doesn't sound like good judgement to me, you need money to eat, and everything else how are you going to do that and pay Sept rent? Congrats on the job I guess.

I know when Hubby got offered the current job, the thing we did not wanna do was make a long haul trip, outa state, hunt for an apt to rent, on top of paying a mortgage, etc, etc, etc.

Heck, sometimes you don't even get that good thing when you move across the company to get it. Twice, I've had written letters for a job that didn't quite come through. Once, I got back from working for the summer (after I already had a letter for my fall internship) and then was told the funding wasn't there when I got back. Another time, I moved for a job, arrived there to start work, and they told me to come back in a month since they weren't ready for me. Needlesstosay, I took out my letter, explained that rent was still due that month, and then had to ask for upper management to clear up the mess--what a way to start working somewhere!!!*** THIS IS NOT LEGAL ADVICE--ONLY A LAWYER CAN PROVIDE THAT. ***

i've since edited my response since the comment it was directed to was deleted. so the madness can stop now. fyi, i moved across the country because i got a good job that is hard to come by in my profession. i considered it the opportunity of a lifetime and i'm excited about it. when you see a light at the end of the tunnel, you go towards it, right? and i did save up for the move, but how was i to know my first payday wouldn't be for a month and a half after i my start date? (but that only means my first paycheck will be that much bigger!) regardless, it would have been dumb to stay where i was.
btw, i did work something out on the delayed paycheck situation w/o having to go to a payday loan. i was only asking advice in case anyone else had been there done that, and i took anon's advice, along w/everyone else's.
