Chapter 13 supposed to be filed on 7/31.. What happens then?

    Chapter 13 supposed to be filed on 7/31.. What happens then?

    So we've been going through this process for a couple of months now. We took an extra month in order to get some new pay stubs after a change I had made so that took an extra month.

    So we've gone through the Credit Counselors going over our debt load with us.
    We then did the means test for Chapter 7 (although we knew all along it would be a 13 we would end up filing)

    Met with our lawyer the other day and he just went over a lot of figures and then went through the items that he considered to be Secured and asked if I wanted to include each in the plan. He basically advised to put most of them in there except for a small Dell bill, one other one and then our Car and House.

    That surprised me but he's the lawyer. He just said it would be cheaper for me to pay these bills through the plan than to pay them direct. I guess I'll see what they try and do. It's like The Roomstore, Conn's, and a Citi Financial, etc..

    So he says they'll get it all typed up and as soon as he gets back from vacation we'll come in on the 31st and sign it and he'll file it the same day.
    He told us to go ahead and start directing any calls from bill collectors to his office (what a relief that will be)

    Anyway, what happens next? According to the lady in his office the rest will pretty much just happen over the phone and through the mail. That true?

    I guess I'm just nervous as hell. If this works out the way it appears on paper right now then this will put an end to suffereing that has been going on for over 10 years but I guess we'll just have to wait and see.......

    Welcome Prodigus to our little bankruptcy forum here, there is lots and lots of good reading here, so please indulge yourself.

    Generally any secured creditors that you have that you are not late on would be better paid outside of the plan.

      Welcome to our happy little Ch 13 filers group, Prodigus! One thing is certain - there will be good days and there will be bad days ahead. Please come here any time to vent, shake your fist at the heavens, and hopefully laugh a little too - just remember that no matter what, we will be here for you.

      06/28/06 - 341 Meeting
      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
      10/05/06 - Hearing to resolve 2 trustee objections
      01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        Thank you both!

        I'm hoping for many more good days than bad but I guess only time will tell.

        The last years haven't been exactly pleasant for me or my family with all the stress of constantly being behind or finagling to get through the months.

        It got to the point where I actually had a VERY difficult time even paying the bills when I had the money just because I couldn't bring myself to even sit down and look at them.

        This was a last resort but one that I definitely feel was the right thing to do...

          Prodigus, welcome and we will be here when you need support. When you start feeling strangled by the chapter 13, just remember what you stated above about the past few years.

          So far, I've been in my chapter 13 for 4 months. 3 months were pretty decent, 1 month wasn't so great, but manageable non the less. Prior to filing, they were all bad months even when I didn't know it...only difference I could actually "hide" because I had credit cards to charge things on.

          BK should always be a last resort and most, in my opinion, were probably bk a year before filing. I was, just didn't want to admit it. Anyway, good luck, and keep us posted.
