    Can I get a part time job?

    Hello,
    I am in a Ch 13, filed on April 20. Payments are made through a payroll deduction.

    At the 341 meeting, and in the subsequent Order of Confirmation, it didn't say anything about having to submit my income tax returns. I won't get a refund, I've adjusted my withholding, because I owe back income taxes to both the IRS and NY state.....so any return I would get would just get snagged by the tax agencies, anyway.

    But my question is, can I get a part time weekend job? I really want to return to school to finish my degree in the spring, and I will need some $1,500 -- I will ask my attorney tomorrow, but I just wondered if anyone here had any experience with part time jobs in a Chapter 13.

    Yep, both my wife and myself have had several throughout the last two years of our Chapter 13, especially when things get tight around the holidays. Once your 13 is confirmed, you'll never really have to worry about your Attorney or the Trustee really. As long as you not doubling your salary or anything.....I wouldn't worry about it. If it is just a part time job to help make ends meet or to save a little, go for it.

    I wouldn't go around advertising it to your attorney or the Trustee, but to be honest, they really don't care. Once the thing is confirmed, they would prefer to never hear from you again

      JMan's advice is fine unless your trustee has instructed you verbally or in writing to disclose ANY increase in income after filing - that varies from district to district. Even if you have a trustee that expects full disclosure no matter what the increase, if the increase is small (<10% of the gross income you used on your filing forms seems to be the rule of thumb for most) and the purpose for the extra job is a good one - paying for school sure seems like a good one to me! - then most trustees are ok with it.

      Be sure to ask your lawyer what the trustee standards are around earning extra income after filing in your district. Don't want to find yourself in trustee hot water if you can avoid it!

        lrpn's advice is correct...I went back and read my post and it did sound a little "shady". I didn't mean to say purposefully hide things from the Trustee or Attorney. The way I understood it was that unless you were vastly increasing your income (like over 10%) then you didn't have to worry about it.
