Trustee meeting was today...what a relief.

    Hi all,

I've been lurking on the forum for some time and I must say that it is a great resource.

I must say that after reading many of the post and horror stories associated with BK and lousy attorneys I was very worried if not down right scared about my family’s financial situation and the prospect of bankruptcy. I did read the Tactical Guide to Bankruptcy and I would highly recommend anyone considering BK to read it completely. It is a great source of information and can help you avoid many mistakes.

If you are considering BK get a good BK lawyer. We got the referral for our lawyer from my In-laws, who filed ch 13 about 2 years ago. I did not stop there though, I called several lawyers in the city we reside, who were not BK attorneys, and asked who they recommended and the same lawyer that my in-laws recommended kept coming up. I'm not sure if this is the most effective way to select a BK attorney but it sure did work for us. It turns out that he had some financial problems in the mid 80's and had to file ch 13 himself...maybe that one of the reasons he is very good at his job.

My experience from the initial consultation to the trustee meeting today has been almost...easy. Through this entire process I have been waiting for a disaster to happen. I'm not sure if it's because we live in Arkansas or we have a good attorney or just luck, but this entire process was not what I was expecting. My wife and I had over $100k in unsecured debt...mostly CC and about $10k in medical expenses from our twin boys that were born in December of 2005. We were close to the edge before the twins came and that pushed us over financially. I think one of the things that helped makes our BK less stressful is that I realized pretty early, before we could not pay our bills, that we were in trouble. We never got behind on a mortgage payment because I knew above all else that it had to be paid. I think the earlier you can realize that your in a bad financial situation that you can't get out of with out BK the better off you will be.

Anyway...I'm sorry if I'm rambling on. I have been celebrating today with a couple(maybe three) beers and just wanted to say "THANK GOD WE MADE IT THROUGH TO THIS POINT ". Hopefully there are no nasty surprises awaiting us.

    Thanks everyone,

    Tim

So glad to hear that your journey is going smoothly, DD! It really does pay off to do your homework first and find a good lawyer. Hope things continue to move on uneventfully - the best outcome for any of us in Ch 13. Good luck - keep us posted on how things are going for you.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

    06/01/06 - Filed Ch 13
    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections

01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
