Forum Rules (Everyone Must Read!!!) (updated: 04/28/2015)

Welcome to the Bankruptcy Forum. Bankruptcy (BK) Forum is known as BKForum.com and will be referred to as BKF hereinafter. In order to ensure a long term success of our vibrant community, we have established certain rules and guidelines to which everyone must adhere to. Please take your time to carefully read our rules, before you start to participate in the community.

Things you agree to do:
BKFORUM.com (BKF) users agree to use the search function before starting a new thread. This prevents duplicate discussions and allows for better organized topics.

All BKF users agree to read the sticky posts which may be available at the top of a forum page. These Sticky posts often contain valuable information. They may also outline more rules and guidelines specific for that particular forum, stickies are put in place by that forums moderator(s) or admin(s).

Things you agree not to do:

All BKF users agree not to call people names or write a post simply to make a personal attack, or get a negative reaction; this behavior is not allowed on our forum. The use of derogatory language aimed at anyone will be severely dealt with. There is no need to agree with each other, or to even like each other. However, by signing onto BKForum.com you agree to treat each member and guest with the respect they deserve. No threats or personal attacks will be allowed.

All BKF users agree not to discuss, engage, or encourage any behavior or activity which violates the law. Discussion of drugs, violence, murder, theft, vandalism, fraud or any other issue which could be used to help individuals break the law is strictly forbidden.

All BKF users agree not to "bump" old threads, unless there is a specific benefit to the community by doing so. But in most cases, please don't post in very old threads, instead start new threads.

All BKF users agree not to attempt/use another members account. It is against BKF rules to use any account other than your own. Impersonating another member will result in an immediate ban. It is also against the rules to open more than one account in your own name without permission from a moderator or administrator. If you have been banned for any reason, it is against the rules to open another account. If you were banned temporarily and you are caught using another account you will be banned permanently. Choosing a moniker which is similar in either sound or spelling as a moderator or administrator is strictly forbidden.

All BKF users agree not to private message any moderator, admin, or other member with questions related to their personal circumstances (Questions about the forum or issues with the forum are ok). This forum only works when members share their experience and insights with everyone.

Things you agree not to post:
All BKF users agree not to post any derogatory/racist/or sexist remarks. This includes attachments, links and all information contained within posts, signatures, and avatars, failure to comply with this rule will result in a permanent ban.

All BKF users agree not to post any copyrighted or trademarked information without the express written permission of the owner(s) / proper citation of source.

All BKF users agree not to post any real names, addresses, telephone numbers, email addresses, social security numbers, or any other personal details (their own or other people's).

All BKF users agree not to post links, pictures, attachments, videos, or the like of pornographic content, objectionable material or extreme violence, whether cartoon or real.

All BKF users agree not to use BKF for advertising purposes without a written contract between yourself/company/agent and the administration of BKF. Blatant advertising will result in a ban.

All BKF users agree not to spam the forums. Spam includes but is not limited to posting erroneous, non-relevant-useless, off-topic, or meaningless posts. Spam may also include posts which contain no text, or large areas of blank space between lines. Simply posting emoticons without text is considered spam. BKF is the largest bankruptcy message board and all the content is intended to help other users. Please help us improve the quality of our forum by making sure that your posts are well-worded, spell checked, grammatically correct and syntaxed.

Regarding actions of moderators and administrators:

The forum is no place to air out your opinion or be judgmental of our staff and its capabilities.

All BKF users agree not to abuse or mistreat moderators or administrators. It is against BKF rules to post any information regarding bans or any other action taken by a member of the moderating or administrative team. If you wish to discuss bans or warnings please do so via PM. To place a complaint against a moderator, send a PM to a super moderator. All Moderators are equal, any decision made by a moderator must be adhered to. If a moderator tells you something you do not like, do not go to another moderator looking for a different answer. If you are caught doing this you will be banned. The moderators work as a team and respect the decisions made by their peers and will help enforce them unless an administrator tells them differently.
If you have an issue with how the forum is run, then notify one of our administrator and we will look into the situation. We have in the past and still do appreciate any input that you offer this forum. But critical input and/or judgmental postings towards the staff will result in you getting banned.


Should you find a thread offensive or out of line, then notify a Mod in a PM so they can evaluate the situation and do the action deemed necessary.

All moderators do have active "other" lives outside of the forum and help moderate this forum in their spare time throughout the days and weeks.

If you have a problem with a member or Mod follow the proper channels of reporting it.

BKF reserves the right to delete any posts which contain anti-BKF comments or discussion. Any bashing of moderators or administrators, or any of their discussion or actions will also be deleted, and the responsible posting party(s) will be banned. Any public anti-BKF advertising, communication, or posts on another forum will result in permanent bans as well.

All warnings and bans are decided by individual moderators and administrators. Warnings are preferable to bans however, for serious offenses and repeat abusers bans will go into effect. The length of the bans can vary from several hours to permanent.

All messages posted or sent including through PM are the property of BKforum.com.

All BKF users agree not to advertiser on the forum (Niether by posting, private messaging or using your signature). If you are a company/attorney/legal adviser wishing to advertise on the site or sell a product, you must contact the head administrator and inquire about our advertising packages.

    I am amazed. I filed chapter 7 on 3/20 and today 3/22 I got an offer in the mail from a car dealer as a "pre approval rapid credit recovery program." It is "0" down and will allow up to 20% of my gross for a monthly payment. The offer fails to mention the interest rate.
    I am shocked as to how fast they responded.

    This is very common. The vultures are coming out ready to pick your bones now that you will have no debt and be unable to file another Chap 7 for several years. I bet they won't actually fund a loan before you are discharged.

    20% of gross? Wow! For me, that would be almost as much as my mortgage payment.

      I posted this because they must of mailed the ad before the ink was dry on my petition.
      They also failed to mention the interest rate.

      I plan to drive my current car until the wheels fall off. Lots of luck to anyone trying to sell me a car.

        We have actually replaced 2 of our vehicles since our bk. One is at 2.7%, the other is at 2.5%. There are some good financing deals out there after bk.

          I would imagine the more money one puts down the better the interest rate.

            I just now applied for the capital one blank check and was approved for $22,500 @ 2.61% for 36 months. Is this good? I don't think I am going to do it, though.

              No money down, financed 100% of price, including tax, title, tag, the works. You hear about how bad it is with a bankruptcy on your report, but our credit score is 100+ points better now than before we filed.

                I can anticipate many situations but the one that concerns me most is if the car fails.

                  I regret not buying a newer car before filing, but am still not putting as much toward repairs as a new car payment. The hard part is dealing with the inconvenience. I could not see how we would fund a ch13 if we had a car payment anyway.

                  iswmle, that blank check loan looks great if it does not bite into your disposable monies too much.

                    It has now been a little more than a week since I filed my petition.
                    I have had eight auto loan offers so far. Most say they are pre-discharge specialist. I have yet to see an interest rate.

                      Interesting. I wouldn't think they'd lend to you prior to discharge because of the risk that you don't get a discharge, then file a new case and include their loan. I guess they figure they don't have much to lose since it is a secured loan.

                        I just purchased a new car with an open no asset Chapter 7 post 341 hearing with a Trustee notice of no distribution.

                        In my situation, my attorney strongly suggested not to reaffirm the 24 percent APR I had when I purchased a 2011 Toyota in early 2013, a rate when I had zero positive trade lines, just returning from living overseas, a loan $4,000 upside down at the time I opted to surrender.

                        A dealership in Fontana, CA, solicited me a week after filing. I certainly was skeptical, as all should be by such offers.

                        But I did the math on potential pricing using Costco Auto Pricing program, the fact that the end of the model year is fast approaching for Honda Civics, and spoke extensively with the dealership's F&I man about my situation to get a strong idea of what terms I would face with my present credit scores and reports. Again my situation may be unique as all of my negative CR were charge offs from 2009, with no younger baddies. I had to resign my $70,000 a year job in early 2008 and and began receiving SSDI and early retirement the same year.

                        I filed Chapter 7 in June, and all of my medical and other open collections disappeared from my reports after disputing by phone and online to IIB or delete. Strangely, my FICOS increased by 80 points after filing, for example TU has gone from 577 in 2013 to 618 after my June 2014 filing and 641 three weeks after my 341.

                        I decided to pull the trigger to see what terms I could get.

                        With an Experian Auto Enhanced of 580, I landed 60 month financing at 14 percent. Optimum, no, but with the clearance pricing combined with Costco pricing I bought a 2014 Honda Civic EX with a MSRP of $21,880 tor $18,590. The dealer had APR point add ons, as they do for folks like me, and wanted 15 percent APR unless I bought GAP coverage at $590, bringing the purchase price to $19,180, which is still $1,000 or more off invoice.

                        Since my skyhigh Toyota loan was at 72 months at 24 percent APR, my new payments are the same for the new Honda at 60 months. I put $3,000 down, so with TTL I financed $18,140.

                        The F&I guy, who by this time I had worked with on the phone for a week or so, said at the conclusion of the deal that if I had waited for discharge, I may have seen 12 percent APR.

                        But by then I would have been looking at limited selection for 2014s and probably a $2015 withe little wiggle room on pricing.

                        All of our situations are unique, and in six months post discharge I will try Cap One for refii. Once my auto enhanced is 600 or better, I've been told I should see single-digit APR offers. Time will tell.

                        Yes, dealers are predatory for situations like mine, but ours, but, frankly, I was shocked at the terms and pricing I was able to get with an open Chapter 7.

                        I'm in the Central District of California. I grilled my attorney on whether I needed trustee approval to purchase post 341, and he was adamant that I could have financed before the 341 with no need for trustee approval.

                          That would be true in all districts. It is Chap 13 debtors who need authorization to incur debt, not Chap 7. Unlike a Chap 13, in a Chap 7, the trustee doesn't have a claim to your post-filing income unless it is income generated by a non-exempt asset.
