Would your attorney know prior to the 341 meeting

if a creditor will show up? Even in these days of non-court appearances?

No one knows if a creditor will show up. The creditor doesn't even know if they will show up.

The only typical appearances by creditors are "usually" credit unions and especially local small banks when you have a vehicle loan with them. Other atypical appearances are disgruntled relatives to whom you owe money but included them in the bankruptcy.

Otherwise, most 341 Meetings are attended by the Chapter 7 or Chapter 13 Trustee (or their representative), debtors and debtor attorneys. The United States Trustee may sometimes be present for certain cases that they want to depose under oath.

The bottom line is this: it's just not worth the effort given that in 95% of Chapter 7 cases, the debt will be discharged. Additionally, Chapter 13s are different and there are hardly ever any creditors at those 341-Meetings either. I mean, why waste your time -- as a creditor -- by attending if the debt will be discharged anyhow? That is why creditors typically don't attend.
    Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
Status: (Auto) Discharged and Closed! 5/10
