    Bank never submitted a claim for a totaled car

    Hello,

    I have a car loan that I listed when I filled. The bank however never submitted a claim and it isn't being paid by my trustee. This is were it gets confusing. Before we were confirmed I totaled the car. Our trustee did not really know what to do with the car so we did not put it in our plan to be paid. We received a check from the inusrance company and used the money to make a down payment on a new car. What do you think will happen with the car loan? They bank never got the money but they also never made a claim. We only have six months to go and I am worried that the trustee will dismiss us because of the insurance check that we cashed 4 1/2 years ago. Our lawyer new about the insurance check and I believe the trustee did too.

    If the lender got notice of your BK, the debt will be discharged. I doubt the insurance check is a problem.
