    Asset case, want to move after discharge.

    We filed a no assect case and trustee turned it into an assect case, but just for our personal property. House and cars were not included. Trustee is sending an appraiser this week to look at personal property. We plan on selling the house after discharge and move to another state. I'm wondering if we have to buy back some of our property on a payment plan will we be able to move or will the trustee make us keep property here till it's paid off. We're in Florida now.

    They'll let you move. After all, if you don't keep your end of the agreement, the trustee can revoke your discharge. That'll happen regardless of where you are.

      As long as you meet the payment plan each month, you will be fine. Your case won't be closed until the payment plan is finished, but there is no reason you can't move and pay the trustee from wherever you are.
