    Colorado 13 before 8 years after discharged 7? Atty says...

    An atty I spoke with said that I could file 13, make a few payments to get to eight years in June '17.

    At that point, he says I withdraw the 13 and file a new, and since it's not a conversion, the filing date being before eight years, wouldn't matter.

    Not sure I think this would fly in the courts. Thoughts?

    And yes... Due to medical costs for myself and an adult dependent, I'm right back where I started in 2008.

    You have a right to dismiss a Chap 13 at anytime. Assuming the proper waiting period has passed since your last discharge, you can file a Chap 7 as soon as the Chap 13 is dismissed. My understanding is there will be some additional procedural requirements if you file the Chap 7 immediately, but your attorney should know what to do.
