Plan amendment going SLOWLY!!

We filed a motion to have our plan amended due to my husband's recent hospitalization. The paralegal originally filed it for August and September after I insisted that we had no other choice. She said they didn't like doing it because it was a lot of trouble to change the wage order and that the trustee really didn't like doing them. (Like I care what they like!!!!!????) No one objected and it was finalized on September 18. Then she remembered I'd said to suspend payments for September and October. That was signed on the 21st. Apparently my husband's employer hasn't sent September's payment yet so "we can't expect them to refund money they haven't gotten."

I'm a little irritated, not so much by the process, but at the unwillingness to accomodate clients. It may be inconvenient for them, but do they really think my husband's two surgeries and complicated case were convenient for any of us?????

Hopefully we will hear something soon. Will keep y'all posted.

Its amazing how the bankrutpcy process sets "dates" and "guidelines" for the filer, but nobody else has any.......................

Sorry to hear about your hubby's surgeries. I hope all goes well.
I will have to be amending our plan do to the fact we now have a major wage increase but we now where given the responsability of a house that was my dads and he no longer wants it, it needs major work and we now have to start paying taxes and liability insurance on it. At the time of filing we were just living here rent free , but that was because I worked for him. He bought the land for his business farm use, now he has sold the business and I have found work elsewhere and we have to take over the house or it will be sold. So I have no idea how they are going to take the amendment. Since I started my new job 1 1/2 months ago we are giving it time because I have a 90 day trial period to see if they keep me at this job. It is a small house but it needs a roof, insulation, siding, a new burner, water softener system etc. The house will be willied to us, so we can't take out an equity loan on it. My father is going to write a letter stating "in lieu of rent" that we are now responsable for the house.
At times I just want to ride the waters and don't say anything and if it ever came up we could just show the papers or receipts of where all the "disposable income" went. But we shall see. We are far from having anything extra right now. We are playing catch up and trying to save for the oil and propane for the winter which will cost abou 2000.00 cause the house is so poorly insulated, and to the tune we have to cover the entire back of the house with industrial plastic because the house can't maintain heat. We live in an open hilltop and the northeast winds are killer hear.
Only because in our confirmation of our plan letter the courts or trustee said nothing about wanting to know about increase wages or having to file our income tax returns to him. It wouldn't matter this year because we were confirmed in August and I didn't start this new job till the end of August so I won't show a major increase in our wages till the end of next year.
Plus our lawyer made the statement to us that at one point "you will beable to make what you want and not worry about it.", "but I am not suppose to tell you", what that all means I don't know.

As Minny said, there's sure not much on the law side that has a deadline unless the debtor is directly involved. Unforunately most bk filers end up with first hand experience with the saying, "The wheels of justice grind slowly".....sigh.... Hang in there - hope the dust around your amendments settles soon!

dac, I agree with the temptation to not rock the boat. In fact, I would discuss with your attorney if rocking the boat is necessary. Sounds like you have an easy trustee.
