I am new to the site. I went through a Ch 13 bankruptcy several years ago with my family. It was one of the toughest times of our life. A few years later I got into the mortgage industry. It dawned on me that I could help people either avoid bankruptcy or provide "life" during or after bankruptcy. Mtg Banker Oh has offered much advice and free information to our forum of his own free will, even though he knows he cannot advertise here......

He has answered many questions for us that some of us are just not qualified to answer regarding mortgage issues, etc...... after bankruptcy...

If all brokers could help us in the respect, their input on this forum would be fantastic and of great help to all of us...

hey Nick, I'm curious about possibility of refianancing our home, can you answer a few question????????
my husband and I filed Chpt 7 last yr and was discharged 6/05, we signed the reaffirmation letter from the mortgage company but it didn't reach them in time, our case was discharged and closed "real fast" from our lawyers standpoint, approx 2-3 weeks after our 341, anyway, we are current on our mortgage and always pay more than our payment. we have other lines of credit but again our reaffirmation agreements didn't get there in time (2 vehicle payments, one which reports monthly to the CRA, then other (National City) whom doesn't, neither which had ever been late. we now have a credit card that we use often but always pay the balance (I pay on it every other week). also have a loan from GMAC that again was included in our discharged but current. our home was appraised in 2000 at 120000.00, we would like to have money out to finish our basement and other cosmetic work around the home. my husband and I both work full time and have been at our current jobs for 8yrs/3 yrs respectfully. we make approx 120000.00 combined income per year. FICO scores are still in the lower 600's d/t multiple reporting errors and continued disputes. My question now is, What's the possibility of refi ing our home, since it was included in the bankruptcy? any information would be great. Thank You Broke Mama. PS We are in Southern Ohio.

It looks like you may need to refinance it to get back onto your reports. If your mortgage is current they will take your payments and will not bother you until unless you come up late then they can foreclose pretty quick since at this time you are almost renting your home. They will not bother you until you miss a payment. Were you debating on including it in the bk and walking away? You can refinance the home you will just have to get a pay history from your lender. What is the house worth compared to what you owe on it? If your scores are over 580 you can go up to 100% of the value, but you rates are going to be better the less you borrow compared to what you owe. I think the only option you have is to refinance either way, especially so you can get the mortgage in your name and reporting on your credit again.

We were never debating walking away from our mortgage. What happened is when the attorney sent the reaffirmation agreement, it didn't reach the lenders "in a timely manner", so they included it in the bankruptcy. We guesstimate that the house is worth approx 140,000 (it was appraised at 120000 in 2000) both my husband and I have credit scores between 610- 625 depending on which agency you use.
