    Cleaning up

    I want to start cleaning up our credit report. I got a free report for one of the credit agencies when I purchased turbo tax. I check just mine and wow it looks horrible. most are reporting, included in bk, but there are still lots showing balances. The one thing I don't really understand is, are our mortgages suppose to be showing included in bk? Our primary mortgage is showing this with zero balance and our 2nd mortgage is showing this with a zero balance but it includes the high amount. We didn't include our mortgages in bk (we filed chapter 7) and I didn't think they would report as if we did. I noticed our auto loan (we have had this since July '06) has not reported anything! We were just discharged this month, so should I wait a month or two to see if anything changes and then start cleaning up?

    Let me make sure I understand - you kept your house, but the mortgage shows IIB on your credit report? If that's the case, this was exactly what I just went through with one of my student loans. I called the finance company and let them know that they were reporting incorrectly (since I was still paying as agreed on the debt!) and it has now been corrected on all 3 CRs.

      A few questions

      When did you file Bankruptcy, and did you do complete a reaffirmation agreement with the various mortgage companies?

        We filed on 9/28/06 and was discharged and closed on 1/12/07. Both of our mortgage companies stop sending us statements soon after we filed. We reaffirmed with both mortgages before closing. Our second mortgage has started sending us statements again but our 1st mortgage still has us making our payments through their special bk dept.

          Honestly, with as much trouble as some people have been having lately, I think ultimately this issue has to be litigated. I am of the opinion that once you reaffirm, your loan should return to normal and should be reported as such. However, more and more creditors are not doing so.

            I'm cleaning up my report as well. Chrysler Financial hasn't been reporting since the BK, and they've been having me go through their BK department to make payments. I reaffirmed with them. I got discharged five days ago. I just made a payment with them and asked them when I could have normal access again. They told me that they have to get the papers from their lawyer, and it could be a month or so until that happens.

            Who knows if the lawyers of your creditors aren't doing their jobs and giving your creditors paperwork to say that they can collect again.
