    Surrending mobile home during chapter 13

    We have been in our Chapter 13 for approx 36 months of our 60 month plan and things are going smoothly. Recently, my grandmother gave me her childhood home and we would like to move into it this summer. We will no longer need, nor do we wish to keep, our mobile home. Our mortgage payments are included in our plan as a continuing debt.

    Can we surrender our mobile home at this point?

    Also, what do I do if I can't locate my atty? he is MIA.

    Also, is it a problem for me to acquire this home while in bk? There is no credit or debt involved. I am in NC.

    Your Grandmother's house is gonna be subject to the Homestead Exemption.

    That website doesn't say whether couples filing Joint can double or not. Hopefully a NC filer will chime in here for you about that.

    If you're in less than a 100% payback plan, the equity of Grandmother's house could cause your plan payments to increase. It's gonna depend on what you're currently set to pay back, how much you've already paid in, and how much Grandmother's house is worth.
