    FIRST payment LOST

    Are you ready for this ONE. I sent my first payment to the trustee Certified mail, return receipt requested due by 1/16/07 this was sent on 1/9/07 and it still has NOT been received. I'M a WRECK. the very FIRST payment!

    Now i'm scared to death it will be dismissed! I do have proof though, i have the receipt showing where it was going and when it was sent with the tracking number.......

    my lawyer tells me that it's not my responsibility of how the postal service delivers the mail. and that they just can't out and out dismiss without the hearing first and that I have the proof.

    He didn't make a big deal about this at all, told me to relax......

    I agree. You have taken all the reasonable steps you can take to ensure the payment is received. Also, it can take some time for the "return receipt" to make its way back, and the trustee may take a few days to process. It's only been 7 days, and there was a holiday.

      Well, I have been in touch with the trustee's case worker and I know it didn't post today. I did however faxed her proof that the item was mailed. I also told her the date it was written, to whom, the check number and it's post stamped on the certified mail copy the date of 1/9/07........

      this is all i can do...........i can't control the mail service............i thought it would have been a good thing to send it this way so i had proof i "sent" it. Probably if i had just put a stamp on it, it would have gotten there the next day but would have no proof of that.

      I just hope it's not dismissed!

        You are lucky you can send in your payments certified mail. I can not do that. And I have had the post office mess up. However, you can stop payment on the check you wrote and reissue another one. I had to stop payment on my money order and then reissue another one. Thank goodness I got it at my bank and stopping it was no big deal. They just called the money gram people and let them know the situation and it was all taken care of. Of course, about a week after I did that, the MO showed up at the trustee's. The post office is not as reliable as one thinks. LOL I wish I could electronically debit my payment to them. That would be the best I think. And it is probably coming down the pipes now that the whole court system is electronically set up for documents etc. Our trustee no longer takes paper copies of anything. Everything from the lawyers has to be sent in electronically. Progress. . . now for the post office . . .. .

          Thanks for your post. I do know one thing, I'm not going to worry myself SICK over this. I have NO control what the post office does with how they deliver certified things. I sent it the best way I thought and have proof it was sent which is better than just putting a stamp on it.

          My lawyer told me to relax........he says they just can't dismiss without a hearing anyway..............but at this point to stop payment on a check that is due today would not really be a good idea to do at this point.

          The trustee's office has the copy of the certified proof that it was sent. I did everything I could to get it there on time.

            I guess I am lucky cause I have sent 9 payments regular mail just adding a stamp and they have all gotten to their location.

              well you are lucky and i was going to do that but my sister told me that with hers she never ever sent it regular mail because if it's lost there's no proof that you sent it.

                Quietsound, Where are you located. I mailed by payment due 1/16 certified mail on 1/9 and it still hasn't been received. I will call the trustee's office tomorrow and inquire, but this has happened before and the trustee's office was very nice about it. This was my 20th payment!! I am not to upset about it because it has happened before and they weren't worried about it, so I won't either. Easier said than done.

                  WOW...........that is really weird.....we both have the same due date and we both sent it out on the 9th. the thing that gets me is if the stamp was put on it first class it would have been there the next day...........does that make any sense???
                  I live in Virginia Beach, VA I just wanted this first payment to run smoothly.......as though life isn't enough trouble!

                    Try to relax. The post office still isn't showing that my payment was received, but low and behold, the check went through my bank last night. Might not have a problem, just the post office being slow updating their records. Imagine that, the post office being slow.

                      well, i can't do anything about it now anyway, i won't stop payment on it. would be my luck they would try to cash it

                        quietsound, I had the same problem last summer when I mailed the check regular mail and two weeks later, they still didn't have it, so I sent them another one next day air and stopped payment on the first check. Of course, that same day, they put through the "lost" check. To make a long story short, it ended up costing me $50 for the stop payment and overnight delivery charge. If only I had waited one more day. I thought that I had solved this problem by sending it certified mail!! Next month, I am going to try and send it through my bank with epay and see how that goes.                           my meeting is on monday at 9am i am not going to stop any check unless someone contacts me and tells me to..........I have not been notified by my lawyer or the court but i know it was not received. i faxed the proof to the trustee's office and to my lawyer and i guess it's out of my hands and unless one of them calls me before monday I won't do anything else about it.........to stop payment on it this late probably would not be a smart thing.....

                          my lawyer told me that this means nothing and if worse comes to worse and it did dismiss it would be reinstated due to the proof of the mailing but would be given the chance to pay it............whatever.

                          i'm so worn out and emotionally exhausted over this whole thing i could just scream!

                            Have you called the trustee's office? I didn't go to my lawyer, but called the trustee's office. They were very nice, she put a note in my file and told me not to worry about it. I did get a letter from the trustee's office after my first check "bounced" that I was no longer allowed to send checks anymore, but after I called the trustee's office, they told me that it was a standard letter and that I was allowed to send checks and they thanked me for being so prompt.

                              Oh yeah, when I saw it wasn't delivered on Friday I talked to my case worker at the trustee's office......she had me call her yesterday to check to see if it was there and she knows all about it and i sent her the proof of shipping the check etc...........i also faxed that to my lawyer as well. i can't do anything else at this point.
