    Yet, another tax return question

A couple quick questions about tax returns. First of all I used Turbo Tax last year and got a paper check tax refund sent to my house after I had filed electronically. Also, my trustee or lawyer has requested tax return info since my filing in Nov 2005. Haven't talked to the lawyer in about 4 months or so. Anywho.....It was under the $1,000 that my trustee in Missouri allows so we were about to keep it. Quote when I called "You can keep up to $1,000". Anyway, I got this free tax cut (H&R Block) in the mail and completed my federal return and am ready to send it electronically. The kicker is this year with this program it doesn't offer paper check returns, just direct deposit. I remember reading post from last year that H&R Block is notorious for intercepting the direct deposit refund due to the chapter 13 that we are in. I recently read the post about the lady that got hers back through direct deposit and I feel good about that. However....... So I would like input on this before I push the electronic filing button. The return will be over $1,000 so how will that work? Will I have to send the overage to the trustee? Many question, I realize but, I just wanna make sure. Thanks

I filed both my Federal and State electronically with Turbo Tax and got both refunds in my bank account.

You will need to send any amount over 1000 to your trustee. Since your in Missouri, I'm guessing Mr. Fink will be getting it. I understand from my attorney, that they combine the state and federal...so if your getting 2K from Federal and 1k Back from state, you would have to send a total of 2k to the trustee.

    Hope this helps.

It really depends on your Trustee whether you can get direct deposit or not.

Some Trustees are sticklers to get the original IRS check. Others don't care.

Where we filed, the Trustee is OK with us filing electronically and getting direct deposit. The Trustee does not allow for people to use Rapid Refund due to the fees involved.

Our attny warned us not to go spending the money UNTIL the Trustee decides if he wants our refund or not. Our attny's had clients in the past get larger refunds, spend the money, and then the Trustee wants the refund. There the people are, having to scrape together the money to pay back to the Trustee.

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

Yep, it does depend on the trustee ... my attorney wanted me to send the 1K I'm allowed to keep to the trustee to get done early she said... I still am not convinced you can get done before 60 months under the new law so until I'm past that 36 month time frame and hear of a few getting out less than 100% payback, I'm chosing not to send the extra in.
