    MTLS and Trustee objected

I had a MTLS filed by the creditors who holds the mortgage on my house. The trustee filed an objection to the MTLS asking for a denial of the motion. Is this good or bad? With this trustee, I don't know. I just know the trustee did not like this creditor when he showed up at the 341 meeting.

This creditor filed a MTLS on my property last year when I wasn't behind and just let it go. There was no prosecution of it period. It just died and was denied eventually. Now he files this one. Attorney says I have a chance of saving home, but I don't know.

Judge has ordered a preliminary hearing: (1) He expects both parties to have conferred prior to the hearing; (2) state any legal and factual issues; (3) time estimate needed, if any, for a final hearing.

Attorney I have spoken with says: 1. I have sufficient equity, 2. I am insured even mortgagor is trying to force additional insurance on me, 3. I will be in a position and I have assurances from FHA for a refinance in March 2008 (Mortgage Banker will give me the paper from their underwriter), 4. I should be allowed the opportunity to catch up, but with the provision of a drop dead provision.
