    Ch 13 mortgage payments question

    Hello,

    I'm a newbie here. Filed a 13 and going have the 341 meeting this monday on 4-2-7.

    I tried phoning in my payment for the mortgage via the banks "speed pay" system but they must have locked me out because my call was directed to the Bankruptcy dept which the recording says is closed until Monday. So, I am overnighting my mortgage payment tomorrow for Sunday delivery but it goes to a P.O. Box.

    My attorney says I have to make all my payments "on time". What exactly is considered "on time"? I noticed on the bill it said if received after 4-16-07 to pay additional late fee because the original mortgage has the 15 day "grace" period. I will tell my him Monday before the meeting about the payment status, i'm just worried they are going to say they didn't get it or something.

    What you experienced is pretty typical when you file BK.

    If you've been paying on-line or via a phone in "speed pay" system, generally, you can't during BK.

    Once you filed BK, your acct was moved from Regular Customer Servicing to the BK Dept. The Reps working in the BK Dept are specially trained. They know what they can and cannot say to you or do with your acct per the BK Code.

    Generally speaking, the original terms of the your mortgage Loan stand, unless or until you possibly modify your agreement with the Lender via Reaffirmation. So if you had a 15 day grace period, then you might be OK with them getting the payment in the office on Monday. Particularly in this instance since the 1st falls on a Sunday this month.

    Were this my loan, I personally wouldn't push the envelope in the future. At least not until the dust settles with your BK. I'd make sure my payments were definitely in to the Lender before the 1st in the future.

      Another possible option is for the trustee to make your payments. I was told I had to allow this to happen, so my weekly payment into the plan is higher, but the trustee makes the payment each month insuring that it is on time.
