    Now what should I do...?

    Hello all, we filed chapter 13 (10/18/06)
    becasue my husband recieved a pay cut.
    We had two cars,a house and some credit card debt.
    We surrendered our cars and wanted to try to keep the house.
    Our plan amount is deducted from my husbands pay each week.
    Since filing things seem to be getting worse not better,becuse of the plan amount each week is very high for us to pay with one income, we became behind in our mortgage payments,we recieved help from goverment agencies
    to help us get caught up, but the mortgage still filed a motion for relief of stay. We accepted having to let the house go into forclousere and want to start over and convert to chapter 7,but Our lawyer without consulting us objected the motion for relief of stay by saying we would pay $370 a month for our past due added to our regular payment each month untill the past due is paid off.We can not afford to pay this,we alreay had trouble paying the regular mortgage payment and now more is going to be added to it.Our Lawyers request was granted and the motion for relief of stay was not granted to the mortgage company.
    Now we are stuck with high mortgage payments and still the weekly plan payment ,and to make it all worse my husband is on STRIKE,so we have no money comming in, and our relying on family memebers for help with food etc.We notified our lawyer of his strike and our inabillity to be able to pay our mortagage plus the extra $370,but he has yet to respond to us.My husband is looking for other work,as for me ,I can't work due to sickness.We would like to just let the house go,because it needs things that we can't afford to fix.
    It states that if the first payment with the added $370 is not made,the mortgage comapny will then be granted relief of stay,so does that mean
    that they will then start forclousere after that? We know we will not have the payment? we justt don't know what to do.We only know we have no money and want to let the house just go becauce it is becomming a burden and money pit...

    They can start the process of forclosure once the stay is lifted. Sorry to hear your having such a difficult time especially with your husband out on strike. All the people I know of who have been involved in strikes might end up making more, but the money they lose during the strike never gets made back up. Hope things work out well for you and your family.

      Forgot to say, depending on what state you live in will determine how quick things happen. Believe me, the mortgage company does not want your home, they would rather you pay what you owe. Unless your in a hot market area, the current conditions of the housing market is something they would rather not be in.

        the strike still stands, but hopefully like you said it will come out to be well worth it.
        we are in ohio and our market is not hot.
        hopefully soon the forclousere process will start and we can move on
        and hopefully the strike will end soon.

          Sorry to hear about this mia. I myself live in Ohio and we let our home go to foreclosure and I can tell you that in Ohio, it can take 12-18 months to finalize the foreclosure. We had made our last payment in August of 2005 and the Sheriff's Sale didn't happen until Jan of 2007........and we are still waiting for the title to transfer! So you will have time to stay in the home (for free) and give you and your husband a chance to recover and then you can move on when everything stabilizes.

          We wish you and your husband well and we hope this works out for the both of you in the end.
