    Chapter 13 and agreed orders

    Filed for Chapter 13 last June. Made first few bankruptcy payments and house payments then fell behind again. Motions to lift the stay were filed on my wife's car and the house. We entered into agreed orders on both the house and the car before the bankruptcy was confirmed. The BK was confirmed in Jan. We have since fallen behind on house and BK payments. Talked to the lawyer and they say catch up on the house and they can push the BK payments to the end. Problem is I am worried about them taking my wifes car. Will the courts let them take the car or does defaulting on the agreed order allow them to just come and take the car w/o the courts permission?

    Also anyody had any luck negotiating w/ Washington Mutual during a BK after defaulting on an agreed order? Don't think we can come up w/ $6500 by the end of the month.

    defaulting on agreed order

    I am currently in a chapter 13. And my mortgage compnay is Washington Mutual. There is no negogiating with them. If you default on agreed order, motion will automatically be granting to dsimiss automatic stay. So what you must do is pay the amount you are due on for them, and not worry about the car. If Washington Mutual is not paid, once they get automatic stay removed, they will foreclose on you. It would take atleast a few months before they came and toke the car. And the finance compnay or bank you got car through, will more than likely work out something to allow you to keep the car. They definitely don't want it back.

    I pray everything works out. But definitely pay Washington Mutual, they are the worst to deal with!!!!!
