    College costs?

    Anyone know if I can deduct college costs in calculating Means test? My wife and daughter are both going to college and I'm paying...do they let you count this? I also have daycare costs associated with my little kids while my wife attends school. This is a repeat post...anyone have any ideas?

    Day care is not a problem, you can deduct day-care expenses (so long as they are reasonable)

    College cost gets a little tricky and whether deduction is allowed will vary by district. I wish I could give you more insight, but I don't really have any on this issue.

      Generally speaking, college tuition for your kids is not gonna be allowed. As one attny told us here, "You are not required, by law, to support your child in college." Your wife may be a different story.

      As HHM said, the college costs issue varies by District. Many Districts simply aren't allowing the deductions.

      It even goes to the extent that some Districts don't allow you to include a child that goes away to college in your Household count. The BK Court reasoning is, the child does not live with you, physically under your roof, for a majority of the time during a calendar year.

      You really need input on this subject from attnys in your specific Court.

        Sounds like the whole thing will be tricky...wife does not work, but goes to school on part-time basis and children are in daycare so she can focus on studies. I really can't afford this daycare for much longer with wife not paying for it, but I'm thinking about trying to keep it up so I can include it in my means test and file a ch 7. We'll see...
