    need a new truck in chapter 13

    been in chapter 13 for 8 mo now, got approved for a loan! drive finacial out of dallas texas, anyways they are asking for a letter from the trustee. western pa district judith fitzgerald is the judge, ronda winnecour is trustee.

    my ?. is has anyone ever bought a vehicle in chapter 13 within 8 mo of being in 13? they are asking for a letter from the trustee, is this normal? i already have the truck, however it is currently has a dealer plate until i can get the letter from the trustee..... any idea how long this takes? do they usually just sign it and return it right away or?

    need help fast

      You're supposed to be in Ch 13, with on time payments for a year before you can incur new debt. At that, the only things you can incur debt for would be the purchase of a primary residence or a vehicle. And only with permission from your Trustee in advance.

      The letter the Lender is asking for is routine and necessary. And with only 8 months into your Plan, you're not likely to get Trustee approval at this point. Can't hurt to try, but chances are, the Trustee won't give you the letter you need.

      Chin up tho. If the Trustee doesn't approve you financing a "new" vehicle at this point,........... You already know a Lender who will approve you. And you can try again in 4 months.

        attorney told me today though that buying a vehicle does not matter for c13... just cannot buy real estate is what he told me, is every state different, or all are the same?
        i actually have the vehicle now, they dealership is just waiting for the letter of approval from her saying it is ok to purchase the vehicle

            we own a large business and one of our trucks are done with. we cannot get it under the biz, as it has only been inc for 1.5 years... BUT we need it now

              i'll tell you in a case like that, it's so vital for you to have this i can't see why the trustee would not give you the letter.........but there again, i'm a person who has been in the program as long as you, and my hot water heater just died and i don't know what to do. only because i don't feel like going to court AGAIN for money to pay for this thing. i'm lucky it's summer and very hot here and don't use much hot water right now but it's very emotional to say the very least.

                  Did you know you can ask the court for a skipped payment because of your situation? You can actually freeze payments temporarily.
