    Early 13 discharge? Update

    Yes it is possible to finish a 13 early in new law.
    We filed in May 06, as of June 07 we had paid all of our unsecured that had filed their proof of claims. $42,000 did not ( go figure) They drove us crazy for the money and when they had their chance they didn't take it.
    Last Friday I called trustees office and was told they would do the audit. Got a check in the mail today for the overages we had paid in since June. Also a letter for "release of wages", and a certification form we had to sign and send back to trustee verifying we do not pay domestic support. A request for discharge will take place as soon as the form is filed. I never knew it would end so soon. We thought we would be in it for the 5 years. I know I will be waiting and checking Pacer until discharged and closed.

    We are so excited and relieved, we know we are blessed for our case went relatively smooth.

    That sounds about right, you paid 100% to unsecured creditors who filed a claim in your case; no one really disputes that you can get out in that scenario. The real test will come over the next year when debtors request to buy-out their plan for the balance of the plan payments but that doing so would pay less than 100% to unsecured creditors who filed a claim.
