    Sorry for all the questions but I have one more. I have over draft protection at my credit union on my checking account and it currently is being used. My account is negative -693.00. Can I include this in my bankruptcy filing? Or will they go back and "unpay" the creditors that they paid? Anyone have experience with this. I have a vehicle I'm probably surrending to them, two secured loans that will be included in the plan, and 2 unsecured loans.

    One more thing, everyone talks about 100% payback, I don't think I'll be paying anything back to unsecured, at least they didn't mention it.

    yes you can include the negative balance in your BK. Put it all in there.

      Sure you can and not to sound rude but YOU BETTER do it, lol. We just filed and we put our negative amount from our checking account. If you don't put it in there with the BK then you'll be paying for it out of your pocket.

        If I were you, I would open a new bank account the day after filing or even the day of filing. The bank your filing on will more than likely close your account.

        If you open one day of filing, you might be able to get the autodraft protection on your new account as the bk won't have hit the credit report yet. I waited too long and was denined autodraft protection due to my bankruptcy.
