    Means Test and Unsecured Creditors

    Is there a website I can go to and do the means test myself and get an idea of what my unsecured percent would be? My laywer never mentioned this to me. She just gave me a "proposed" payment amount and said it would include (IRS, back RE taxes, 3 vehicles, Arrears on 1st and 2nd Mortgage). That's all she said. Maybe because my secured debts already don't leave disposal income, I dont know, that's why I was wondering about this. Has anyone had a very low repayment for unsecured in their plan?

    From what I understand (someone please correct me if I'm wrong) the percentage is determined AFTER the creditors submit their claims. That way, if some creditors don't submit claims, the ones that did receive a higher percentage. The payment amount can stay the same, but the percentage can go up or down depending on which creditors file claims. So I don't think there is any way to determine a percentage at this stage of the game.

      I don't think I'm going to show disposal income, when she was doing my budget it was negative. But can't do a chapter 7, because of previous discharge. I guess I'll just have to wait and see. Maybe unsecured will each get a couple dollars.

        I guess in that case the unsecureds would probably get 0%. But how are you going to pay the secureds if you have no income? Did your attorney say whether the Trustee will likely approve the plan with no disposal income? All of this BK stuff is so complicated huh? UGH.

          I'm talking about after the plan payment she came up with and then the general deductions. She said the numbers they use on the means test are higher than what I listed for expenses (I guess there are standards?)....like for a family of 4, I put $500.00 for groceries, she said that's low. My budget shows about $75.00/month disposal after everything. I have no idea, guess I should just wait and see, I'm sure they'd get a small amount........She did say, that the payment might adjust "slightly, very slightly" after the means test, whatever that means. I just hope this all works out as planned, I'm getting rid of a major upside vehicle and have got a more economical vehicle now, and this is catching up my mortgage arrears and saying my house, hopefully all works out well. IF I have to go without cable or something, to may a portion to unsecured, and that's what the trustee says.....guess that's what I'll do. She didn't seem to see a problem at all. I know her "goal" is to kind of not have any money put into paying unsecured.
