    Many questions....

    We just hit the 36 month mark in a 60 month plan (60%). We are looking to relocate in a few months. I have many questions, and am very unhappy with the lawyer we used to file. What process is involved (or is it possible) to switch lawyers? We would like to sell some of the items we retained through our filing (including our home) and pay off the plan early in order to move. I know we need to get permission from the court to do so, but does anyone know if this is even possible? Will it bump us up to 100% because we want to pay early, or are we okay after 36 months of on time payments? The largest part of our payment is the mortgage, so what happens when it is paid off? We will need this amount to rent our next home.

    Since I believe your under the old law chapter 13, the law only required all disposible income for 36 months. Once you made it past the 36 month time frame, you could make whatever amount you could and it didn't need to be paid to the trustee. You would only be responsible for the "pot" amount. You should be able to pay off early with no problem and pay the pot amount.

    If your going to sell you home to pay off the Chapter 13, then technically, once the Chapter 13 is satisfied, your out from under the umbrella of the trustee and you can do whatever you want with your money!

      I was hoping that was the case. I am very eager to relocate, and have feared that it just wasn't possible. As long as we can find the right buyer and get the right price for the house, we'll be fine!
