    Last Payment!

    Greetings,

    Logged into NDC this morning and saw that all my creditors have been paid and about half of my last payment is showing as a positive balance. Woot! Case status is "about to close" and things look good!

    I just wanted to say "Thanks" to all of you for making this forum tremendously informative to the working class people like myself. Your thoughts and feedback to the issues posted here have been invaluable in dealing with the stress of going through a chapter 13.

    Also, good luck to those of you still working through your plans. If I can do it, I guarantee that all of you can as well!

    Finally, I'm curious to see if anyone has filed in the Northern district of California. I'm wondering how many more payments I'll be making before they discharge my case. This is important because they presently garnish my wife's wages, and she is on maternity leave, meaning that when they try to get her paycheck next month, there won't be anything to garnish (won't they be surprised lol). Anyone have any experience with this?

    i cant tell you how long you have to wait in your district, but I do know that you need to pay until the trustee says stop, regardless of how much positive balance is.

      I wonder if this is handled differently in different areas? When I got to the point where my unsecured creditors were about to get their last payments, I contacted my attorney and he filed a motion to stop the wage attachment. The motion was approved, and the next month they stopped taking the money out of my paycheck. I received a letter from the Trustee's office telling me that I had to start paying the two mortgages myself. There was a complication in that my plan term had been increased from 36 to 44 months because of an increase in my mortgage payment. It took them over a year to start making the higher payments, and by that time all of the unsecured and priority creditors had been paid. Now I am done paying into the plan (it has been 36 months), but it looks like I still have eight months left. My attorney has scheduled a hearing for December to deal with these issues and reduce the plan term back to 36 months. Hopefully my case will be closed shortly thereafter (maybe I'm dreaming). At least I'm not sending 75% of my paycheck to the Trustee anymore. It might be worth checking with your attorney to see if the wage attachment can be stopped once all of your creditors have been paid.

        I'm in Indiana and I watched my plan weekly. When I got to the point where there was an overage and all my creditors secured and unsecured were payed off, I sent a request for payoff to my trustee(hint hint). It brought to her attention in a nice way that I knew I was done. Received a motion and order to terminate pay from coming out of check about 5 days later. Talked to payroll department at work and they said the following week would be the last week after recieving order. Now just waiting on trustee to audit my case so I can get my refund and be discharged. Congrats to you.
