Our CH13 was dismissed after 1 yr - what to do now?

    All of us - including us MODS - have rowed the same boat as all of you. Fortunately, our boat has reached land again and docked.

    We, as MODS, try our best not to sound judgemental (though sometimes we may - even me). We have all experienced the bankruptcy process and have felt all the "blows" from it.

    And yes, the Truth does hurt, and sometimes a hard pill to swallow. And yes, we do get on the defensive also. Its a part of human nature to "buck up" when confronted. Hackles and fangs often show when we're already stressed out.

    We here on the Forum, Welcome all Newbies. The purpose of our Forum is to help YOU, offer suggestions, offer sources of information to you, and be a "buddy" for you and a "shoulder to cry on" thru your bankruptcy process.

    We welcome your input, will try to understand your situtation and guide you best we can. But we too, are only human.....we too make mistakes, and sometimes criticize when that's not what we really mean to do....

      If your house is in your mothers name and she has the mortgage on it - AND she is willing to refinance the home again in her name to help you - THAT IS GREAT. Allowing enough to purchase another vehicle is a thought but you will be paying on it a long time......

      If you could swing a vehicle (possibly used) in your own name for a couple of years it would help boost your credit score back up with timely payments. Paying off all the creditors will also boost your score back up.

      By getting your finances straightened out again, getting everyone paid off, THEN in about 2-3 years you could purchase the home from your mother in your own name. Your credit score should be reasonable by then even with a "dismissed bankruptcy" on the report.

      A suggestion..............unless you are an heir to the home in the event of your mothers passing.(since the mortgage is in her name only)............. think about taking out insurance on the home (you pay it for her) that pays the home off if something happens to your mom - such as disability, or passing. This way the home would be protected from foreclosure, etc from the bank or mortgage company. The cost of this insurance is really not that much and can really be a good investment to protect your interest in the home as long as its in your mothers name. Just be sure that the home is "willed " to you and is not part of the estate.

      It's great that your mother is able and willing to "help" you in this matter. Most people do not have that kind of help to fall back on.

      Maybe with your mothers help, new jobs and better salaries, and getting creditors back under control, your financial future will look a lot better soon.

      Another route you can take is file Chapter 7.............(in the mean time have mom purchase a car (in her name) for you to drive. After your chapter 7 is dimissed, 2 years down the road on good interest rates, you would be able to buy the auto, buy the house at decent interest rates back from your mom. All your old debts/creditors would be wiped out in the Chapter 7 and you would get a fresh start to build a new life on.
