    Ch13 Dismissal

    Newbie here

    I had a CH 13 that was dismissed 5years after it was filed (attorney was disbarred - big mess). It has now been over 7 years after the orginal Ch13 was filed. What happens to the debts that were included, do I know owe the whole amount with interest back to day 1 or just from the date of the dismissal? Also, what happens to the Statute of Limitations on the original debts?

    Any help would be appreciated.

    You need to speak to a local attorney about the Statute of limitations questions. If I had to guess, I would say the Statute of Limitations will start from the date of dismissal.

    Basically, you will owe the amount due plust interest from the date you FILED the chapter 13, minus any payments made by the chapter 13 trustee to each respective creditor.
