    Just wanted if anyone to see if anyone filed waaay before the laws changed and am wondering how their final was handled....mine is 60 months and according to recent information via a phone call (made by me) to the trustees office, my monthly amount needed to be increased. So I now pay bit more. Albeit I have wondered why I never had any notice concerning this shortage. Strange, huh?

    My % from the beginning has been 18.82% to unsecured. Had no secured.

    BK end is in sight and I sure don't want or need any OTHER surprises.

    ps......gee I just discovered Brett used to post here......too bad he is gone.....he was on another site but that site sorta went to the dogs.....so to speak

        So if you had never called, they never would have upped your payment? How can that be? And why did they do it? I thought once the plan was confirmed, that was all you needed to do?

          Good question, as I wondered that myself.

          All I have ever gotten so far, from the trustees office, have been semi yearly statements showing payments.

          I didn't ask any questions because if the boat doesn't rock, your feet don't get wet.

            EndInSight, I can't answer your question as to how the end went, I'm waiting myself. I filed 13 in 2003 as well and I was supposed to finish in 2008. By good fortune, I was able to make a payoff 9 months early, which I just sent the payment a little over a week ago. It was posted on 13datacenter.com this past Friday.

            I'll report back what happens to me and my discharge.
            Chapter 13 Filed "Old Law"
            Filed: 6/2003 Confirmed: 3/2004
            Early pay off sent: 10/05/2007 - 9 months early
            11/16/2007 - Discharged!

              When you make your final payment, the Trustee will have to perform and Audit of your Case. How much money came in. How much got paid out and to who.

              Once the Audit is done, if everything settles up A-OK, your case will be Discharged and Closed.

              If you filed BK with an attny, the Trustee's Office would likely contact your attny of record and not you directly. Possibly there was a breakdown in communication with your attny's office regarding the need to increase your Plan Payments??!!

                That's a good point. I was told about the increase in my pay. Plus also, it was in my court order ... the "confirmation?" I'm not sure what that document is called, but it's "official."

                It plainly states (on the LAST PAGE - to be sure to read everything) that I was to pay a certain amount to the trustee, and then it told me at what date my payment went up. It has not gone up since (and I did call my trustee for a final pay off amount ... I would think that I would be told for an increase in pay.) And I have been paying that second amount since.
