HI, I hope someone can help in this matter. Brief run down......We filed Bankruptcy Ch 13 in Sep 07. 341 meeting last month went good, trustee said we qualify for early confirmation....GREAT! We are current on all payments to trustee (thank you payroll deduction) BUT I made some mistakes after I filed:
1) I got a payday loan. I thought I just couldn't get "credit" .
Not sure if this is a mistake like #1 but wondering now.
I have no dental insurance, I need 2 root canals and 2 crowns ASAP! I have to pay off those stupid pay day loans before I get "caught". I got a stupid ticket from our County for our alrm permit expiring, have to pay $300.00 by the 20th. Family problems, etc.....I can go on and on because we all know when it rains it pours. So I get some advice from a co-worker about taking from my Thrift Savings Plan from work. Not a "TSP loan" that I have to repay but just getting some of what I put in. So I look into it and I don't qualify for "negative cash flow withdrawal" because Ch. 13 protects us against that but dental and medical and general hardship I do qualify to take an early withdraw. So I did it. But then my co-worker tells me today that TSP notifies IRS and the IRS will get their 20% right off the top for early withdrawal. Now here's my question will IRS notify my trustee about this? What should I do? I really need this money, and it's mine...I put into it for years now. Of course when I file my tax returns I have to put that money down but will the trustee see my returns? I'm not trying to be sneaky we just really need this money right now. My payments to the trustee, cut in hours and all of the above have me more stressed out then before I filed. I just want to be above water for a change and not worry about paying this person back, we cant get a loan and have no family to ask.
Thank you SO MUCH FOR any help and or advice.
