    Is there a minimum amount of disposable income?

    Does anyone know if there is a minimum amount the courts will accept as disposable income? My atty. filed ch. 13 for us this week and I see a mistake in the list of our monthly expenses (property tax was left out.)If that amount is added in there will be about 59.00 left for disposable income my atty is not available to talk to right now and my husband thinks the courts must have a minimum dollar amount they will allow in ch. 13??? Anybody know?? We are in CA.

    If you have less than $100 per month in disposable income, you CAN file a chapter 7. (assuming the expenses you have are reasonable).

    Are you filing chapter 13 to save some item of property?

      We have a mortgage and we have assets the atty. said we can not protect if we file 7. We live on 10 acres and have a few horses and a cow and some other small livestock I said would the trustee seriously want to liquidate our 20 year old horse and sell the cow?? He said not likely but possible. I guess we own too many things that could be liquidated.

        You should talk to a few other attorney's.

        Is the attorney's concerns about exemptions...i.e. there is too much equity in your real property...etc. I think there is an exemption for livestock in most states.

          I am really not happy with the attorney we are using but I don't know what else we could do we already paid him $1500 and he filed the petition this week. When you can't afford the best atty. you have to take what you can get for the money you have and I am afraid now we are in trouble.
