    I'm finally filing tomorrow..2 more questions

    I'm finally going to file the 13 tomorrow and just typing it makes my stomach feel uneasy, but I know its what I have to do.

    But I do have one other question. I read somewhere that a first payment to the trustee is due within 30 days of the file date, however the meeting of creditors don't take place until about 30 days out too. Can you give any feedback? I just want to be sure that I am timing everything right and budget for Christmas and all.

    Also, if any of you have read my past threads, you know I am surrendering 2 condos. I have paid current up until this month. I will not be 30 days past due until Dec 1, so if I file on Nov 30 will the mortgage companies report 1 over 30 or do they show IIB? I know it sounds crazy that I'm concerned about that, but I wanted the real manner of which I paid to be accurately reported. Any feedback?

    Hi there. I was sick over filing 13 myself, but am already happy I did, and I just filed mid-September of this year.

    You are right, you have to make the first payment within 30 days of filing. My 341 wasn't actually scheduled until mid-November, so I had made two payments before my 341, it all just depends on how busy the trustees schedule is as to when the 341 is scheduled for, but the payment MUST be made within 30 days of filing or they'll dismiss your case.

    Sorry, don't know anything about the forclosure question.

    Good, luck, you are on the path to getting your finances straightened out, and while it's scary, it's a very good thing.

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

      Also not able to help with your question but I'd like to say that for about 6 months before I filed I was so stressed out That I could hardly sleep and the weeks before I filed it was even worse

      And i'm not going to lie, the whole process with the lawyers, trustees and court was a huge headache

      But now after only being in my plan for a few months I can not even begin to tell you how much better I feel. It's like a huge weight has been lifted and I'm able to go to sleep at night without nightmares of all my bills going on in my head

      I'm no expert on this stuff trust me but one piece of advice i'd give is have your lawyer get your expenses up as high as they can to lower your payments. My lawyer had me max out my 401K plan contributions and had go from claiming one down to zero

      when I finally got my payment amount from the trustee, when I went back to claiming one and lowered my 401K contribution my 13 is only costing me about $100 a month..... this is after having over $1000 a month due each month in credit cards.

        According to my atty the 1st payment is due by the 25th of the month following the month you file. We were going to file at the end of Sept. so we waited until Nov 1st so our first payment is due Dec. 25th.I don't know if it is different ,in different states, we are in CA.
