    I apologize in advance if this has already been covered. But last night I was thinking, would I be able to convert to a chapter 7?

    I filed a chapter 7 with my now ex in 01 (march/discharged in July, 01 and closed in July) I filed my now chapter 13 in August 05 and have a few more months to go. (about 8 or 9 total) So my question is:

    It has been 6 years (old laws) and I filed the 13 under the old laws. But. . . is it from 01 to 05 or 01 to current 07? I sent an email to my attorney but he hasn't answered. LOLOL

    I'm sorry to tell you that the 6 year time frame goes from 01 to 05. They use the filing date, rather than the conversion date to calculate the time frame. I converted my 13 to a 7, and am now having to convert back to a 13 due to this time line. My old attorney (who no longer does BK's) said that I could convert... My original was in 2000 and the latest was in 2005. I found out about the dates from the US Trustee via letter.
    My main reason for wanting to convert was that we've unforetunately accummulated more medical bills, and with our 13 payments, can't afford to pay the all the new med bills.

      thanks for the info. I am just so anxious to be done with all this. And my dilemma is that my lease here is up August 1 and that is just about the time I will be discharged. I really want to try and buy a house. The timing is just all off.
