    Ok I'll try to this again.

    Maybe my last post was too long....
    So I'll ask 1 important question

    I have a creditor that I am delinquent with abour 120 days and they have submitted it to collections. I would like to hold out another 90-120 days before filing Ch 13. The debt is very large. In order for them to garnish wages, they would have to get court permission, correct? Thus they'd have to file, I'd get a summons.... which I'd have say 3 weeks to answer, a court date would then be set for say a month or 2 out etc. Is this correct? I.e. I pretty much don't have to worry about wages being garnished or having a judgement against me happening within the next 60-90 days? I have to get a summons, right? They can't just go around me and have a court agree to a garnishment, correct?

    Yes you would have to get a summons and court date! Which you could call and extend the court date to buy some time BTU 120 days is going to be a strech! Good luck
