    Insurance Claim Check not Released

    Back in July, I had a weather event where my roof needs to be replaced. The homeowners insurance paid off and gave me 180 days to replace the roof. CitiMortgage's name was on the insurance check along with mine, so I sent it in so they would release/sign and return it to me so I could re-roof before winter set in. I sent the check in without my signature, hoping to head off this problem in the first place.

    My fear was, if I signed it first, they would just keep the money and I would be out the new roof. As for BK 13 timing, I filed about 2 weeks after the damage was done to my house. This is where I think there definately should not be a problem with them releasing the check.


    I have mailed certified letters and numerous e-mails with never a
    reply. What are my options? Thanks in advance.

    I would be on the phone with the insurance company and let them deal with citi mortgage. The insurance company will know IF that check has been cashed without your signature. I would let your insurance company know what is going on.

      I wrote them last week

      to tell them about it and to see if it was cashed. Should not have been without my signature.

      Would the insurance company even care?

        yes. It is fraudulent for that check to be cashed without both signatures. I wouldn't write them a letter, I would be on the phone screaming for action. I guess I am not a very patient person.
