Plan Deficient? Anyone know?

Okay, so I'm checking Pacer to keep up with what's going on with our case.

We filed 12/06. On 12/07, this was entered:

Order Deeming Chapter 13 Plan Deficient

The order says:

A model Chapter 13 plan has been adopted by this District. The use of the model Chapter 13 plan is mandatory consistent with General Order No. 07-02. The proposed Chapter 13 plan submitted in the above-capitoned bk case does not substantially conform to the District's model plan, which is available on the Court's website (lists link). Therefore, it is:

ORDERED that the proposed Ch. 13 plan filed in the above-captioned case is deemed deficient. The Debtor(s) have until December 23 to file a Chapter 13 plan substantially conforming to the model plan adopted for this District, or, to file a motion setting forth in detail why the use of the model plan should be required in this case.



What does THAT mean?

Weird, too, is that on 12/09, the meeting of creditors was filed, giving a date for the meeting??

I checked the link listed in the order and it just takes me to the main page of the website. I'm not sure what it is I'm looking for, but does anyone know what this could mean? Could this mean that the atty didn't file something that needed to be filed?

Are you pro se, or with an attorney.

All it means is that you need to get the Court's "Model Plan" and amend your filing. Basically, the court is telling you they want your chapter 13 plan on a specific form.

Thanks! That's what I was kind of starting to think after I dug around a bit on the bk site for my district, so I called my atty's office. Of course, he's in court today, but the secretary said she'd give him the message, so he better get to it! LOL
