    What are the consequences of this?

    I received a huge packet of forms today from the trustee. We have our 341 next week and I have to have this paperwork done by then, and then also file this monthly report every single month. From what her letter says, she has "identified" our case as a business case. I don't even bring in poverty level income from my transcription "business," my husband makes 8 times more than I do and is a regular employee, but yet, we're a business case.

    Anyway, other than having a huge pain in the rear of filling out this monthly report, what are the consequences? Will our case be handled differently in any other way?

    Sorry for so many questions. I have left message with our atty, but he isn't returning my calls, of course.

    No, your case should proceed as normal.

    Since your income is self-generated, the trustee is simply requiring you to document your income so that the trustee can "keep you honest" about your disposable income, I guess.

    There really is no such thing as a "business" chapter 13. This designation is probably something this trustee uses to identify cases where the debtors income is self generated.

        I got one of those packets too. Although it said ours is supposed to be returned before the confirmation hearing. It is a pain having to fill all that out especially since we just started our business and I am not that great with Quickbooks yet.

          Yeah, our hearing is next Friday, the 25th, so I'm just assuming that she wants to get the ball rolling because subsequent reports are to be to her by the 15th of the month. And yes, what a pain! I don't use any type of software or anything. I do the work, send an invoice, get paid, deposit the money in to our account. I don't have a separate business checking account and I just keep receipts for expenses in a folder for our accountant to figure out when we file our income tax return.

          I suppose I should invest in some software for this.
