I know the trustee makes a % (our's is 6%), but do they make the percentage based on total claims that are being paid back or the total claims. My total claims so far are over $550K, but I am surrendering $520K of the claims.

In my case, the trustee is getting 4 percent of the monthly payment. My monthly is 556.50 so basically after he disburses, he ususally gets about 20.00 or so. It isn't really much in exchange for the peace of mind I now have. -
The % is based on the amount you pay into the plan, it has nothing to do with the claims.
The %, itself, is determined by the BK Court for that district..Comment

my trustee only take out 2.7%. Has anyone ever heard of such a low percentage? Since I'm not in 100% payback for my 13, it doesn't really matter to me, but it seems like he gets very little for his work, which is maybe a good thing for me since he has also been real reasonable (had a few minor objections to my plan, but we were able to get everything straightened out and no increase in plan payment before confirmation.)Filed CH 13 September 17, 2007
