    What gives

    While awaiting our ch 13 to be closed we filed in 2003, looking on 13 datacenter it was showing z= Near Completion, then today it now says "Active" with a balance of over $5k.....This was even showing on thier paperwork as a closing date of Jan 4. They also took us from one percentage of payback all the way to 100%. Now the darn thing wont close till Sept.

    THat sucks I would get on the phone to your attorney asap! Why would they take you form 1% to 100% must have got a huge raise or bonus

            Could just be someone working in your file and trying to close things out? Our 13 data center still shows our payback as 70 months (we've been paying for a year and it's never changed)! It's so confusing--my attorney says they will update it when THEY feel like it, but she knows our plan will only be 60 months--it can't be longer...yikes! LOL. I wouldn't go off of that info as it recalculates all the time when data is entered--talk to your attorney and find out what's up!?!?!

              was your plan for 60 months? or 36? It can't go longer than 60 months no matter what. When do you hit the 60 month mark?

                According to her that would be in 2 more years, I thought any additional income after the 36 month period would be considered out of the extra income bracket under the old laws. Plus maybe she just has a greedy trustee. Unfortunately she will probably have to pay an atty more money to find out about that 5k balance. I will revert back to my original quote RAT BSTRDS !

                  RRockin, We filed in March 03 so our 60 months should be up on our date of filing....Trustee says it will now be an additional 5-7 months....Good God!!!!

                    I wonder if this is a trend even though filed under the old law. My creditor percentage was raised by the trustee last fall from 35 percent to 61 percent. That takes me right up to filing date 36 months later. I bet that is happening all over. Man the end can't get here fast enough

                        Not sure why they do that, Makes me sick, now I have to shell out 5500 additional, If I knew this would have happened, I would have just did the best I could and paid it myself 100%. Atty acts as if he does not care, but of course he is paid in full all $3200 of it. This hits hard because it takes almost 70% of my pay.

                          Call your trustee's office and ask them. We noticed some issues with our Datacenter account--it said we were "eligible for audit" and that our case was closed on Jan. 27, 2008, even though we are 9 months into a 60 month plan. We called the trustee and they said there have been issues with the Datacenter site and that the information was incorrect--we in fact do have to pay the remaining 51 months. So, hopefully it is just some glitch with their system.

                            Update, since we have moved since the ch13 began, and before you ask yes all info is current with atty and trustee, we have come to a new option, let a friend of a trustee look at our paperwork and see what he/ she thinks.... Hum seems kinda sticky for a trustee to increase from 37.83% all the way to 100% and not say anything.....
