    What happens when income goes above state median during ch13?

    I'm 10 mos in to my Ch 13 - everything has been flawless so far. I was offered a promotion at my company today. While making my decision and negotating compensation I wanted to be informed on what happens if my income goes above the state median - or doesn't it matter since i'm in a confirmed plan?

    Does your trustee require tax returns annually? What are the rules in your area as far as reporting increases in income?

      My Lawyer said he'll probably ask for them at some point, but I don't have a requirement or timeframe to send them in.

      I'm in PA, not sure about rules for reporting income.

        I would ask your lawyer, alot of trustees want to know of pay increases since it means you can now pay more toward your debt, unless you are in 100% payback already. We were told our trustee really does not care after your comfirmed, but I'm still not going to push my luck, we try to stay less that 5% above where we were when we filled

          I don't think it's the State Median Income that matters as most 13 filers are already above the median income. I think it's more of how much of a percentage increase it is to you personally? I would ask your lawyer, but if it's more than 10%, you may want to increase your 401K deductions, or ???, to stay under the radar of your trustee. Your lawyer will be able to advise you best since all trustees are different.

            You could give it to charity or tithe to your church !!!!! Hopefully this will keep everything going smoothe in your life during BK. Because everytime I think it is going good something happens. I would guess you have someone looking over you and you would not want to mess that up. Just remember to keep your reciepts....

              So is it based on the adjusted gross income, rather than actual salary?

              Here's a little more of my story. I filed Ch13 while running a business (income/profit <$30k), have sold-off most of the business, keeping a small area (that nets 5k per year). I got a job w/ a salary at 55k (state median in PA is 75k). My new position will include a salary around 75k + commission and bonuses. I tithe (that's give 10% of gross to my church) and give a fair portion of my income, spend $2-$3k in pre-tax medical expenses (through a flex spending account). If you back out my chartiable giving, medical expenses, mortgage interest, etc. in this new position, my adjusted gross is under $75k - and if not, what a better reason to give more...

              I guess this is a bad problem to have. This Ch 13 has enabled me to change course in my life, I'm 10 months in - I've stayed out of debt, been able to save enough to stay out of trouble and am able to maintain a comfortable lifestyle within my means. This promotion is an incredible blessing, and if this can happen with little to no impact to my bankruptcy...

              This forum's been great through my whole bankruptcy - I appreciate everyones input and the sharing of their experiences.
