we just bought a vehicle, financed 20,000 for 6 years. We will be filing in 6 to 8 months from now. We pay 364.00 a month for it. What would happen to it in a 13. Do we just keep paying the 364.00 for the 6 years, or does that get put into the payment plan over the 5 years . Thanks

You should be able to keep the loan through your finace company outisde of the plan so you pay them directly! Filing 6 to 8 months from now that is a ways out???

Reaffirmations do not apply in a chapter 13. You either make the payments outside the plan (i.e. you continue making payments), pay inside the plan (i.e. you pay the trustee and the trustee turns around and pays the creditor), or you surrender the property.

If you pay through the trustee then it will cost you mroe monthly becuase the trustee will want his % of the total payment and 368$ more will add at least 10$ monthly I would say!
