I'm actually TiredandWeary's husband.
As she has stated previously we are currently in a nightmare in our 13. Our monthly payment towards creditors is actually VERY manageable. The problem is our demon mortgage. it is an ARM currently at 12.12% which has translated into $600 extra each month.
Now we already have the mortgage lumped into the trustee payment (paying the additional 6% fee) so now our monthly payment is $3160/mo... needless to say we can't float this for very long.
We've waited patiently for 12 months to be able to qualify for an FHA refi. We started the ball rolling just to find we've been flagged with late payments by the MC since june of 2007!
After we called our lawyer he found out from the trustee that the MC changed their mailing address and one of their disbursements came back and the trustee refused to send any more checks until the MC verified a new mailing address.
Now our attorney has email/called the MC's lawyer several times, both to get them to update their address with the trustee as well as give them a chance to 'fix' the illegal late flags out of court. Well it's been over a month and of course the MC hasn't done jack. Not even updated their address to get their money!!! It's mind-boggling.
We even filed disputes with all three bureaus and one has come back saying nothing is wrong with the accuracy. LOL
So as of this morning our attorney is filing sanctions against them. Looks like we may be going to court soon.
It's just sad that the MC is being so STUPID! They are perventing us from geting a refi because they show 180 day lates since last year on us when we have well over $22k in our trustee account.
We're not worried about being dismissed at this point. Our attorney has assured us that we have all OUR T's and I's crossed and dotted and we have a great case. He's also going to have back amounts adjusted into our schedule and have our Schedule I & J adjusted as well to try and get some relief until we can refi.
Thank God we have a great attorney.
Anyway, just wanted to say hi and hopefully we'll have good news soon.
