    Confirmation Question

    Ok, we went to our 341 meeting. Obviously, we were terrified because you just don't know what to expect until you're there. I have a question. At the end of the 341 meeting, the trustee told us that she was recommending our plan for confirmation. Does that mean it's as good as confirmed?? I'm assuming it has to go to the judge and he/she gives the final approval. Can the plan still be tossed out by the judge? Thanks for the info.

    As long as none of your creditors object to your plan, it should be good. Our trustee was going to confirm as well, but one of our creditors objected and after several months of negotiating, we ended up having to pay more money into the plan, despite the fact our means test said we didn't have it.

      does it matter if all of our creditors are unsecured??? Here's keeping my fingers crossed too.

        oh, and none of the creditors were there today either...does that have an impact? How long do they have to file a claim?? Our attorney said that some haven't filed a claim as of yet and we filed the end of December.

          It doesn't matter if anyone is there, they can still file a complaint. They have 60 days from your 341 to file a complaint and 120 days from the day you FILE BK to file their proof of claim. What do you mean by, "does it matter if they all are unsecured? " That has no bearing on confirmation. So far we are at 41% payback but our creditors got an extension due the fact that the court didn't put any date on our paperwork for a deadline for them. UGGGGH! Now they have until March 10th to file a claim and March 31st to file a complaint to disputing the dischargability.
