    confirmation approved...couple of questions

    I appreciate anybodys input.
    1. whats next? any potholes designed in the road?
    2. looked on pacer and my car is in there??? I am paying them on the side.....not supposed to be in the plan.
    3.If the car is in the plan do I get a smaller car payment?

    We put our car in the plan, and the interest rate was dropped to 6%. Also, it's another payment we don't have to worry about...and yes, you could pay less. It all depends on how long you've had the car, as you may only have to pay for the "value" of it.

      every debt is "in" the filing, whether you pay it inside or outside the plan. For example, my student loans are part of my filing, even though I don't pay them in plan and in fact can't get them discharged by law, still has to be listed there. Same for my morgage, I'm paying it outside the plan since i wasn't in arrears, but my morgage company is there in the paperwork since you can't not report a debt and it's all used to determine your CH 13 plan so all in the paperwork. They've changed the rules for cramming down cars to actual value, you need to have made your loan agreement more than 3 years or so ago (don't know the exact amount of time, but I think it's close to 3 years) but if your loan is old, that is a possibility as MajorMike said. However, if you have a decent interest rate on your loan, and your trustee charges a high % fee, and you can't cram it down, it could end up costing you more to put into your CH 13 plan, so you'll need to research that topic more to see what is best for you.
