I am self employed and this month has been really bad. I have not paid my mortgage this month and probably will not be able to pay it until the 28th. My confirmation is on the 27th and one of the objections was proof of mortgage payments. I needed to have that turned it by this coming up week. What will the trustee do and the mortgage company? I am going to call my lawyer tomorrow to discuss with him.

I thought you could include morgage arrears in a CH 13, can't you? Why does trustee want proof of morgage payment? Is he/she trying to force you to include morgage payments inside the CH 13 instead of outside the plan? If that is the case, could be bad that you haven't paid yet. What did your lawyer say?Filed CH 13 September 17, 2007
Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

One of our trustee's objections filed last week was that she didn't know if our mortage payments were up to date and we needed to provide proof (which they are current, so I'm not sure why this is a big deal). Anyway, what I got from the paperwork we received with the objections is that she cannot suggest confirmation if she doesn't know whether the mortage payments are current.
I would definitely talk to your atty. I mean your confirmation is on the 27th and you're going to pay it on the 28th. It's only one day.
Let us know what your atty says!Last edited by jnjw; 02-19-2008, 08:24 AM.
