I think I may know the answer to this, but want to ask to make sure. Don't want to ask my lawyer since he may tell the trustee that this may happen and may just cause me trouble. Anyway, the apartment I'm living in is owned by my parents-- I pay them $700/mo, which is what was reported as one of my expenses when I filed. My father said he would just sign the apt. over to me, but I told him wait a few years when I'm more financially stable to handle the extra expenses like property tax, maintenence fees etc... (he doesn't know I'm in Ch. 13). I would like to get the apt. in my name but would and could pay off these extra expenses every month but don't want to mess up my Ch. 13. Would I have to go back to the lawyer and trustee and restructure the plan? The apartment is valued at around $350,000. I owe my creditors 24,000, and will pay them back 13,000 during my 4 year plan. I started around July 2006.
One thing I thought of was I can get the apartment in my name and just take out a home equity loan and pay back the full amount I owe to everybody and end this whole ch. 13 plan, but I would have to do this without my parents finding out which I think would be pretty hard. I just cannot let them down any more, if they found out i've ran into financial trouble again the dissapointment would kill them. I also wonder if my creditors, after finding out i've got the apartment, will they sue me for interest and such that they had to stop charging me when this bk started? or any other fees?
