This year we are getting back 1000.00 and the the rebate check will be 1800. We will be filing a 13 in july or aug. Will they count that as income? Or is it just considered tax money and they could decide to take it if they want? Thanks again

Probably income as there is a long time between you receiving your tax refund/rebate and filing bankruptcy. -
It will likely depend on your state and your trustee, My refund was included as income, but alot of people say thier tax refund was not included, ask your lawyer if you have one, he/she should know whats typical for your area. We recieved our refund a couple of months before filling spent it. The trustee never even asked about it or what we spent it on. But like I also stated it was included as part of our income so he probably figured he was getting anyway just more slowly.Comment
